They are so named because they are stipulated in court.
However, they are not succumbencial, since they are not derived from the succumbency in the process.
It is up to the judge to fix the amount owed, according to the remuneration compatible with the work and the economic value of the matter, in compliance with the OAB tables.

Assistance fees
Another modification introduced by Law 13,725 of 2018 is the forecast of the assistance fees.
Thus, paragraph 6 of article 22 of Law 8.906 / 94 on fees fixed in collective actions proposed by class entities in procedural substitution.
Its purpose is to provide accessibility to the Tables of Fees of all the States of Brazil:
